Students’ body battles for HC bench in Berhampur

BERHAMPUR: South Orissa Students' Association (SOSA) has expressed its solidarity with the agitating lawyers of South Orissa and has demanded early establishment of a permanent bench of Orissa High court at Berhampur- the nerve centre of activities in southern part of the State. SOSA president RP Tripathy said southern Odisha has remained the forgotten frontier of the State with alarming levels of poverty and underdevelopment. While majority people of South Odisha are living under abject poverty and backwardness their genuine demands have been repeatedly overlooked by the state government. The students' body pointed out that lawyers had been demanding establishment of a High Court bench in the city for the past six decades. Both the lawyers and general public of south Orissa have resorted to agitations for this demand in the past. The SOSA activists urged the lawyers in Cuttack, especially the ones of the Orissa High Court, to get out of their insensitiveness towards the problems of people from far off areas to approach the High Court located in Cuttack. It may be noted that the Bar Association of the Orissa High Court and the Cuttack Bar Association boycotted courts on Monday to protest against the statement of Union Law Minister Veerappa Moily in favour of the establishment of High Court benches in Orissa during his visit to Sambalpur. The SOSA activists through a press release expressed surprise that how delivering justice at the doorstep of the poor through benches of the High Court could be opposed by them. They pointed out that former President of India V.V. Giri and former Chief Minister of Orissa Biju Patnaik had openly supported the demand for establishment of High Court bench in Berhampur. They alleged that delay in establishment of permanent benches of the High Court in parts of the state was depriving people of south Orissa their right to get justice at their doorstep.
While recommending a High Court Bench at Berhampur in 2007, the State government opined that there was an urgent need for this in view of the backwardness of the region, popular mood and large number of cases originating from here. As per SOSA, cases from south Orissa constitute more than 30 per cent of the total cases in the Orissa High Court. The geographical spread of south Orissa makes the need of a High Court bench in Berhampur an inevitable one. They said that Berhampur had all necessary infrastructure for the establishment of a permanent bench of the High Court and it was well connected to all parts of south Orissa. The SOSA urged the lawyers of the Orissa High Court to give up stubbornness and support the demand for the interest of the general public. They urged the Union Law Ministry and the State government to expedite the process of establishment of High Court benches in the State.

In short Patna hc has been constituted by issuance of letter patent constituting high court of Patna by great Her Magesty in the year 1916,and to expedite the justice dispensation system and to make the indigent & poor people to enable at handreach of justice,after just 4(four) months after such constitution of Patna hc on dated 18th may 1916,a circuit bench of such hc was established at Cuttack and started functioning since suchday.Later on responding to demand made by Cuttack Bar Association,Orissa Legislative Assembly finally got a resolution for establishment of separate and independant high court for the province of Orissa and placed on dated 03 / 04 / 1948 before the Governor General through the Governor for the province of Orissa.On dated 30 / 04 / 1948 the then Governor General by invoking his authority delegated by virtue of section 229,Government of India Act,1935 passed statutory order popularly known as Orissa High Court Order,1948 constituting Orissa High Court and got established at Cuttack.So Orissa High Court at Cuttack had celebrated its first working day on 26th july 1948. Likewise the state namely Orissa constituted its capital at Bhubaneswar,at a distance of 29 kms away from Cuttack and within the compact area from Cuttack to Bhubaneswar entire public offices pertaining to govt. & non-govt. including media centre and judiciary are being held.On the other hand western orissa is laid-by, at a distance of 300 to 500 kms away from Cuttack-Bbsr.Western Orissa is comprising of 10 districts where as total districts in Orissa is 30.As this region were in Central Province and southern orissa were in Madras Presidency ,people of respective regions are quite distinct with people of Coastal Belt in respect of languape,diet,appearance,culture,rites and rituals.Western Orissa people travel through simplicity,indigenity,acute poorness and dalits.Always struggle for their survival.So these people have been facing stringent hurdle in getting their depends at Coastal Belt regions.In consequence whereof, for the first time a demand for having a bench of Orissa High Court had been raised in the year 1959 and at different times agitations in several manner has been continuing and in the year 1991 an attempt was taken by ours beloved and highly respected Chief Minister late Biju Pattanaik,but his noble attempt had been held kneeling down before some influential evil minded persons appearing as , not lesser than of Coastal region in high chair of the state. Again the lawyer class of the society took the task of agitation.On dt.30th April 2006 on the calling of District Bar Association,Bargarh,entire bar associations of Western Orissa comprising of 10 districts assembled at Bargarh under a common banner namely "Central Action Committee,Western Orissa Bar Associations"and committed to bestow their best to make effective the mass agitation demanding ESTABLISHMENT OF PERMANENT BENCH OF ORISSA HIGH COURT AT ANY PLACE WITHIN WESTERN ORISSA. Seeing the gravity of their dedications,on dated 08 / 11 / 2007 ours Chief Minister Shri Navin Pattanaik wrote a letter to hon'ble Chief Justice ,Orissa High Court justifying such establishment,but entire lawyers of Cuttack Bar including High Court Bar went on stir by paralysing their respective courts,tribunals and forums demanding rejection of the C.M.'s request.Their plea to reject the request was, if the bench of Orissa High Court would be established at places other than Cuttack then their livelihood will be affected.Ultimately such request has been turned down and they were found succeeded.Where is justice for western orissa ? Where is integrity among the people of Odisha ? ?.. However the lawyers and people of western orissa region have been continuing their prolong agitation for high court bench.Besides government and judiciary,the media personnels also are behaving with step-motherly attitude with this western orissa region.Tomorrow will see howmuch injustice this region bear !
